SPONSOR: The sponsor of the RestimDM Contest is Greentree Labs, Inc. (“Sponsor”), PO Box 1410, Lake Grove, Oregon 97035 

ELIGIBILITY: Contest is open to legal residents of countries where adult content is legal at least 21 years of age (“Eligible Participants”).  Void where prohibited by law.  Contest is subject to all applicable federal, state, and local laws. This Contest is in no way sponsored, endorsed or administered by or in association with Instagram®.  Sponsor expressly reserves the right to disqualify any entries that it believes in good faith violate these rules or any applicable laws.  Except where prohibited by law, entering the Contest constitutes Participant’s permission for the Sponsor and those acting under its authority to use Participant’s name, photograph, likeness, statements, biographical information, voice and address (city and state only) on a worldwide basis, and in all forms of media, in perpetuity, for advertising or promotional purposes without review or further compensation.  By participating, all entrants agree to abide by these Official Rules. 

PROMOTION PERIOD: The Contest will begin on Wednesday, November 7, 2018 at 12:00am PDT and ends at 11:59pm PDT on December 18, 2018.  Eligible participants may post multiple Submissions (as defined below) throughout the Contest Period, but each participant can only win 1 prize.  All entries received after the Contest Period will be automatically disqualified.

HOW TO ENTER: During the Contest Period, here’s how to enter:

(1)     Send one (1) photograph showing the most creative display or use of RestinDM (Submissions must be original works created solely by you that conform to the standards listed in the section below) to restindm@gmail.com by stated deadline; and

(2)    Include a statement in English about why you are excited about RestinDM or what you love about RestinDM

You may submit multiple entries (each a “Submission”) throughout the Contest Period but can only win 1 prize.

CONTENT OF POSTS AND REPRESENTATIONS & WARRANTIES:

By providing a Submission, you represent and warrant that:

  1. your Submission does not at any time infringe or violate any laws or any third party rights, including, but not limited to local obscenity or pornography or child pornography laws, publicity or privacy rights, copyrights, moral rights, trademarks, patents, trade secrets, or any other intellectual property or other rights of any third-party;
  2. the Submission is the original creation of the Participant and has never been displayed or published in any media form, including, but not limited to, the internet, radio, video, television broadcast, or print, and has never been used or submitted in connection with any contest previously;
  3. the Submission does not include any person other than yourself;
  4. Participant has secured all necessary permissions for all visual and audio material contained in the Submission and has the right to use and license such materials in any and all media without limitation and without compensation.
  5. Participant will defend, hold harmless, and indemnify Sponsor, its officers, directors, and employees against all damages, claims or liabilities, and expenses (including legal costs) arising out of your Submission.
  6. Sponsor may disqualify any Submission it deems inappropriate at its sole discretion and without notice.

AWARD OF PRIZES: One Winner will be selected from three (3) potential winners based on the highest number of points awarded (“Points”), which will be awarded by a panel of three (3) judges based upon the following criteria:

  • Creativity
  • Artistic quality
  • Prominence of RestinDM product.

Entries and prizes are nontransferable and cannot be redeemed for cash. No substitutions are permitted, except that Sponsor reserves the right to substitute a prize of equal, lesser or greater monetary value or cash value for any prize.

The Contest winner will be announced on December 19, 2018.  A total of three (3) potential winners will be selected in ascending order of Points awarded.  The potential winners will be contacted in ascending order to verify their eligibility and compliance with these Official Rules and the Prize will be awarded to the first potential winner with the highest number of Points that verifies that he or she meets all of the eligibility criteria and returns all required paperwork and documentation.

Sponsor reserves the right not to award a prize if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Prize award is subject to verification of eligibility and compliance with these Official Rules.

PRIZE:

The prize (“Prize”) consists of stated reward with submitted candidate. Winner must be of legal age and located in a jurisdiction where such Prize is legally permitted to receive the Prize.

PRIZE REDEMPTION: Upon selection, the potential winners will be contacted via email. The potential winners must claim their prize within five (5) business days after the date of notification. It is the potential winner’s responsibility to check their email accounts for notification. If a potential winner fails to respond to the prize notification within the specified five (5) business days, the potential winner will forfeit the prize and an alternate winner will be selected. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to be submitted by the person in whose name the email account is used to register for the Instagram account. In the event any Winner engage in behavior that, as determined by Sponsor or prize provider, in their sole discretion, is obnoxious, threatening, illegal or  intended to annoy, abuse, threaten or harass any other person, Sponsor and prize provide reserve the right to terminate the prize or any element of the applicable prize early, in whole or in part with no further compensation or liability.  Winner and Guests must obey all Official Rules and complete any paperwork required for the prize, including but not limited to any additional releases, contracts, waivers required by the Sponsor and prize providers and, failure to sign such paperwork or to furnish all required information by dates selected will result in forfeiture of the Prize. In addition, Sponsor and provider of the Prizes reserve the right in their sole discretion, to disqualify any potential winner if such potential winner is not eligible to be awarded the Prize, as determined by Sponsor in its sole discretion.  Winner and guest must travel on a date selected by Sponsor and provider of the Prizes.  Winner will be advised of such date after being awarded the Prize and must travel on such date or the Prize will be forfeited and awarded to an alternate Winner.  

ENTRY REQUIREMENTS: Your entry must be your original work and not contain any unauthorized third party copyrighted works or trademarks or any material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights.  You should be able to provide all appropriate clearances, permissions, and releases for your entry, otherwise Sponsor reserves the right, in Sponsor's sole discretion, to disqualify your entry. Your entry must not disparage any other person or party, including Sponsor or contain any material that is hateful, tortious, defamatory, slanderous or libelous, or that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, that is unlawful, or in violation of or contrary to the laws or regulations in any state where the entry is created, in each case, in Sponsor’s sole discretion.

BY ENTERING THE CONTEST, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND BY ALL APPLICABLE LAWS AND ALL DECISIONS OF SPONSOR (WHICH SHALL BE BINDING AND FINAL) AND TO WAIVE ALL OF YOUR RIGHTS TO BRING ANY CLAIM, ACTION, OR PROCEEDING AGAINST ANY OF THE PROMOTION ENTITIES, AND TO RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS EACH OF THE PROMOTION ENTITIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES, FROM ANY LIABILITY, COSTS AND EXPENSES (INCLUDING ATTORNEY'S FEES) THAT MAY ARISE IN CONNECTION WITH YOUR PARTICIPATION OR INABILITY TO PARTICIPATE IN THE PROMOTION.

Sponsor reserves the right to suspend or cancel the Contest or modify these Official Rules as necessary for any reason or as required by applicable law. Sponsor reserves the right, in its sole discretion, to disqualify from the Contest, and ban from any future promotions, any person it believes to have violated these Official Rules, or to be acting in an unsportsmanlike, deceptive, or disruptive manner, or to have tampered with any element of the Contest without notice to the disqualified or banned person. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants and Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the State of Nevada without giving effect to any choice of law or conflict of laws rules or provisions. Any legal claims arising out of or relating to the Contest or these Official Rules must be brought in the federal or state courts located in Las Vegas, Nevada.

There is no purchase or fee required to enter but the RestinDM product must be featured in the Submission.
